Oakville Suzuki Association Terms and Conditions

Welcome to the official website of The Oakville Suzuki Association (“OSA”) (https://oakvillesuzuki.org). Use of this site and Membership within the OSA is governed by the Terms and Conditions set forth. PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THIS WEBSITE OR REGISTERING WITH THE OSA.  The information and materials provided by the OSA may be used for informational purposes only.  By using, accessing or downloading materials from this website you agree to follow the terms and provisions as outlined on this page, which apply to all interactions with the OSA, both now and in the future.  The OSA may at any time revise and update the Terms and Conditions. You are encouraged to periodically visit this page to review the most current Terms and Conditions to which you are bound. If you do not agree to these Terms and Condition, please do not use this website and contact the OSA registrar.
 

A.   Disclaimers

(a)      Live Activities and Events

The OSA brings music education to children in Oakville and surrounding areas. As part of the Suzuki philosophy, children are strongly encouraged to participate in group classes and a wide variety of performance opportunities.  The OSA facilitates some private lessons, group lessons and performance opportunities at Queen Elizabeth Park Community and Cultural Centre (“QEP”) in Oakville. Occasionally, performances are also held at other public spaces in the community, including churches, seniors’ centres, shopping and community centres.  While we want the children to benefit from the experience of performing in public and make every attempt to make sure the venues are both safe and comfortable, we want you, as parents, to also recognize the risks of performing in public locations.

By agreeing to these Terms and Conditions, I acknowledge, in my role as parent or guardian, the inherent risks with my child attending classes and / or performing in a public location.  I recognize the risk of injury, albeit small, and voluntarily assume that risk.  I do further release the OSA, its officers, directors, volunteers, employees, agents, and affiliates from all liability for any injury incurred during lessons, performances or other OSA events.

(b)      OSA Web Site

The OSA Internet team strives to provide you with useful, accurate, and timely information and materials on this website. In doing so, the OSA may change or update said content at any time without notice.  Notwithstanding same, the OSA makes no representation or warranty regarding the accuracy or completeness or currency of the information and materials on its website.

Information and opinions expressed in bulletin boards or other forums are not necessarily those of the OSA. Neither the OSA, nor its officers, directors, volunteers, employees, agents, nor affiliates are responsible or liable for any loss damage (including, but not limited to, actual, consequential, or punitive), liability, claim, or other injury or cause related to or resulting from any information posted on the OSA's website.
 

B.   Online Purchases

The following are the terms of the agreement between you (“Buyer”) and the OSA for the purchase of goods or services through the OSA website.  If you do not agree to these terms, you will not be able to purchase anything, so please review these terms carefully.

(a)      Payment

Buyer represents and warrants that (i) the credit card information supplied is true, correct and complete; (ii) charges incurred by the Buyer will be honored by the Buyer's credit card company; and (iii) Buyer shall pay charges incurred by Buyer at the amounts in effect at the time incurred, including all applicable taxes.  Buyer agrees to keep his or her password confidential and shall notify the OSA within 24 hours of any breach of this contract or unauthorized use of the password.  Buyer shall be responsible for all charges incurred through use of Buyer's password and the OSA will not provide refunds for unauthorized transactions purchased with Buyer’s login credentials.

(b)      Refund Policy

All refund requests must be submitted in writing by email or letter to the OSA Registrar, and will be governed by the following policies:

Requests submitted prior to November 1st of current school year will be subject to the following conditions

  • OSA Membership fee will be refunded minus an Administrative fee of $25
  • Group class fees will be eligible for a pro-rated partial refund (OSA arranged at QEPCCC only)
  • Private teachers determine policies for lessons held at their own home studios

Refund requests submitted after November 1st but before February 1st of the current school year

  • No refund on OSA Membership fee
  • No refund on OSA arranged Group Classes held at QEPCCC
  • Private teachers determine policies for lessons held at their own home studios

Refund requests for Memberships, Group Classes, and Private Lessons after February 1st of the current school year are at the discretion of the private teacher and OSA Board of Directors

Cancelation and refund requests for the OSA Summer Camp will be accepted until June 30th of the current year.  A $20 non-refundable administration fee is applicable.

C.   Privacy Policy

It is important to the OSA that our members’ privacy is protected while registering for our programs. To protect your privacy, the OSA follows basic principles for privacy and data protection.

  • We will not sell or give away your name, mail address, phone number, email address or any other information.

We will ask you when we need information that personally identifies you or allows us to contact you.  Generally, this information is requested when you create a user account on the site and register for our programs. We use your personal information for three primary purposes:

  1. To make the site easier for you to use by not having to enter information more than once.
  2. To ensure you or your child(ren) are placed in the appropriate class or programs.
  3. To help us communicate information relevant to you.

Notice to Parents or Guardians: we want to help you guard your children's privacy.  We encourage you to talk to your children about safe and responsible use of their Personal Information while using the Internet.  The OSA offers a Family Profile, linked to a parent’s user account.  This allows parents to control the collection, use and sharing of children’s personal information and allows parents to enroll children into OSA programs.

(a)      What We Do With the Information You Share

When you join us, you provide us with your contact information, including your name, address and email.  We use this to send you OSA information and news updates.  When you register for a program, we ask for your credit card number and expiry date.  We use this information only to bill you for the program(s) you order at that time.  The OSA does not retain your credit card details.

The OSA will disclose your personal information, without notice, only if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on the OSA, (b) make an application for grants or awards which have specific residency requirements, (c) protect and defend the rights or property of the OSA, and, (d) act in urgent circumstances to protect the personal safety of members of the OSA, or the public.

(b)      Access

We will provide you with the means to ensure that your personal information is correct and current. You may review and update this information at any time in the Family Profile section. There, you can:

  • View and edit personal information you have already given us.
  • Proceed to register for OSA programs.

 

D.   Restrictions

The information and any materials (including papers, press releases, data sheets, program descriptions, and FAQs) available on or from this website are the copyrighted works of the OSA, and any unauthorized use of that information or materials may violate copyright, trademark and other laws.

Any rights not expressly granted herein are reserved.  You may view, download and copy information and materials available on this website solely for your personal, non-commercial use.  As a condition of use, you agree not to modify or revise any of the material in any manner, and to retain all copyright and other proprietary notices as contained in the original materials on any copies of the materials.  No other use of the materials or information is authorized.

You shall not post or transmit through any material which violates or infringes in any way upon the rights of others, which is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane or otherwise objectionable, which encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any law, or which, without the OSA's express prior approval, contains advertising or any solicitation with respect to products or services.  Any conduct that, in the OSA's discretion restricts or inhibits any other user from using or enjoying the OSA website will not be permitted.
 

E.    Links to Other Websites

As a convenience and to make the OSA website truly service oriented we have included links to complementary sites on the Internet. These sites are owned and operated by third parties. The OSA makes no representation and is not responsible for the availability of, or content located on or through, these third party sites. A third party link from the OSA website is not an indication that the OSA endorses the third party or its site, or has any affiliation with or between the OSA and the third party hosting site.
 

F.    Termination of Use

The OSA may, in its sole discretion, terminate or suspend your access to all or part of the OSA website, for any reason, including without limitation, breach of this agreement.  In the event this agreement is terminated, the restrictions regarding materials appearing on the site and the representations and warranties, indemnities, and limitation of liabilities set forth in this agreement shall survive any such termination.
